LAFAYETTE TOWNSHIP BOARD OF ZONING APPEALS

Regular Meeting

July 3, 2008, at 7:00 p.m.

Vice Chair Dave Parker called the meeting to order at 7:00 p.m.  New member Nanci Shanley was introduced to all present.  Roll call indicated five members of the Board of Zoning Appeals were present:  Dave Parker, Jack Blank, Mark Riffle, Andrea Kacinari and Nanci Shanley.  Paul Calvo (alternate) and Jack Chester (alternate) were also present.  Zoning Inspector Alliss Strogin, Zoning Commission Chair Karen Schoonover and Trustee Don Butler were also present.

 

Minutes

There were no minutes to be approved as the minutes from the previous public hearing held April 23, 2008, were approved on April 30, 2008.

 

Correspondence

Handout material received from the Lafayette Township Fiscal Officer Shirley Bailey included:

-         Ohio Ethics Commission handout (receipt acknowledged by Board members);

-         Lafayette Township Open Records (Public Records) Policy (receipt acknowledged by Board members);

-         Ohio Department of Public Safety, Division of Homeland Security, Public Employment Declaration Regarding Material Assistance/No Assistance to a Terrorist Organization (Declaration acknowledged and signed by Board members).

 

Other handout material provided to the Board members included: June 2008 and July 2008 Grassroots Clippings newsletter, Medina General Hospital On The Clock Care upcoming seminars in the 2008 IMPACT seminar series listing, Lafayette Township Zoning Resolution Amendment regarding Section 308 Chippewa Resort Overlay (CRO) District (which was effective 5/16/08) and letter dated 5/20/08 from Attorney O’Connor relative to the status of the pending lawsuit (CCP #08 CIV 0557) Eck v. Bady et al.

 

Zoning Secretary Marlene Oiler also indicated that she had printed out a copy of the Agreed Judgment Entry (CCP #07 CIV 1424) Bedford v. Gruber et al filed May 27, 2008, which concludes this case.

 

The Zoning Secretary also announced that she had handout materials on Planned Unit Developments for distribution if any of the Board members needed another copy.

 

Old Business

The election of officers was tabled at the January 2008 meeting until the township trustees named any new or replacement members to the Board.  The township trustees recently named a new member to the Board and two alternates.  It was agreed that the election of Chair and Vice Chair for the balance of 2008 would proceed.

 

Vice Chair Dave Parker asked for nominations for the office of chair.  Jack Blank nominated Andrea Kacinari for chair, seconded by Dave Parker.  Jack Blank moved that nominations for chair be closed, seconded by Nanci Shanley and the vote was unanimous that nominations for chair be closed.  The Board proceeded to vote for the nomination of Andrea Kacinari for chair; the vote was unanimous.

 

Newly elected Chair Andrea Kacinari asked for nominations for the office of vice chair.   Dave Parker nominated Mark Riffle as vice chair, seconded by Jack Blank.  Dave Parker moved that nominations for vice chair be closed, seconded by Jack Blank and the vote was unanimous that nominations for vice chair be closed.  The Board proceeded to vote for the nomination of Mark Riffle as vice chair; the vote was unanimous.

 

New Business

(1)        Brenda Scott-Stormer (Section 301 and 210) to build a pole building as a replacement for an old barn.  A copy of the application papers received was distributed to the Board for review.  Zoning Inspector Alliss Strogin explained that many of the lots in the Chippewa Lake area were small and were platted before zoning was in effect and therefore it was difficult to meet side/rear/front yard current zoning requirements.  This particular applicant owns three such lots but still would be unable to meet zoning requirements without a variance.  Another issue is that the address is on Eastlake but she is supposed to be fronting on Overlook Drive, which was never completed.  The house fronts Eastlake, the drive in on Eastlake and the mailbox is on Eastlake.  She asked the applicant to work up the variance figures using Eastlake as well as Overlook.  These lots are part of a platted subdivision that goes back

 

The Zoning Inspector suggested to the Board that it might want to consider issuing a blanket variance for lots such as these in the Chippewa area (define it by streets or a section number on a map, etc) indicating that such preexisting nonconforming lots in this area have certain defined setbacks.  It was indicated that she had already discussed this possibility with A.P. Thorne.  This matter was discussed and the zoning inspector will follow-up with the Prosecutor’s Office as to procedure as well as potentially coming up with draft language that could be considered.

 

A date for scheduling the public hearing on this variance application was discussed.  It was determined by the Board that Tuesday, July 22, 2008, at 7:00 p.m. would be the public hearing date and the secretary will proceed to handle the legal notices.  It was also determined that each Board member would be individually responsible to do the site inspection for this variance application.

 

(2)        The secretary announced that she had received from the zoning inspector a Conditional Use/Site Plan Application from GGP Development (Mike Cavey/Medina Country Club) for Medina County Club-North PUD Subdivision.  A copy of the application papers received was distributed to the Board for review.  This matter was briefly discussed.  The Board will be reviewing the Planned Unit Development handout materials as well as the PUD and all other appropriate code sections in the Lafayette Township Zoning Resolution.  Zoning Commission Chair Karen Schoonover suggested that the Board specifically look at wetlands, frontage/side yards, and check for sidewalks on the preliminary PUD subdivision plan.  There was brief discussion relative to the procedure and requirements relative to a traffic study.  Trustee Butler stated that he thought the driving range appeared to be very near the county bike trail.

 

There was discussion relative to the possibility of needing a work session to review the application and in particular the MCDPS Staff Report.  It was suggested that after the public hearing was held if the Board felt it necessary to schedule a work session to further review this application, it could do so and the public hearing could be continued to a new date and time.

 

A date for scheduling the public hearing on this conditional use application was discussed.  It was determined by the Board that Wednesday, July 23, 2008, at 7:00 p.m. would be the public hearing date and the secretary will proceed to handle the legal notices.  It was also determined that each Board member would be individually responsible to do the site inspection for this application.

 

Announcements

-         Public Hearing on the Scott-Stormer Variance Application is scheduled for Tuesday, July 22, 2008, at 7:00 p.m. at the township hall, 6776 Wedgewood Road, Medina, Ohio. 

-         Public Hearing on the GGP Development Conditional Use/Site Plan Application is scheduled for Wednesday, July 23, 2008, at 7:00 p.m. at the township hall, 6776 Wedgewood Road, Medina, Ohio.

 

Adjournment

Upon motion by Mark Riffle, seconded by Nanci Shanley, it was unanimously approved that the meeting be adjourned.  Meeting adjourned at 8:10 p.m.
