LAFAYETTE TOWNSHIP BOARD OF TRUSTEES

SPECIAL MEETING     

Thursday, June 4, 2009

 

 

Meeting was called to order:  5:00 p.m. noting that meeting was properly advertised as required by Ohio Revised Code 121.22, followed by the Pledge of Allegiance.

 

Members Present:  Trustee Donald Butler; Trustee Lynda Bowers; Trustee Lee Kehoe;

Fiscal Officer Shirley Bailey

Guests:  Assistant Prosecutor Tom Karris and Assistant Prosecutor David Folk

 

Others in attendance: Ms. Sue Heizsek and Mr. Pat Catlin

 

Trustee Bowers made a motion to recess into executive session in accordance with the exclusion under Ohio Revise Code: 121.22 open meetings law for personnel compensation.  Mr. Butler asked for a second, Trustee Kehoe second the motion.

       Roll Call:  Kehoe, yes, Bowers, yes,  Butler, yes.

Moved into executive session at 5:05 p.m.

 

Trustee Bowers moved to reconvene at 5:23 pm

Explanation for executive session, Fiscal Officer Bailey explained due to a workers’ compensation injury and a loss claim, we were advised that it may be best for the township to pay the wages (an average wage) until the worker is released by his doctor to return to work.  It is the best for the township, less expensive, because if we have Workers’ Comp pay the salary (wages) then our rate increase would be greatly impacted and causing at least a $10,000 increase next year on our Worker’s Comp.  Trustee Bowers stated that it was important to note the amount of wages we are talking about is $727.68, significantly less than the increase we would suffer.  Ms. Bailey mentioned that the amount per week would be $121.28, by averaging payroll for one year, [the injured worker was part time, as needed, with one year of wages used to average out the wages per BWC.] If the worker is off six (6) weeks (as expected)  it would come to a total of $727.68.

 

Trustee Bowers moved to approve resolution #22-2009:  A resolution for wage compensation due to a work related injury and loss time. At this time it is in the amount of $727.68, Trustee Kehoe seconded the motion, all voting in favor, resolution passes.

 

Fiscal Officer Bailey advised that it was time for the advance taxes.

Trustee Bowers moved to approve resolution #21-2009: A resolution authorizing the fiscal officer of Lafayette Township to make a request for advance of taxes collected to the Medina County Auditor, Trustee Kehoe seconded the motion, all voting in favor.

 

Fiscal Officer Bailey passed to Trustee Butler the advanced collection certificates (3) to sign.

 

Fiscal Officer Bailey  handed out to each  Trustees copies of the “0” Tax Budget which they had requested at the June 1, 2009 meeting.

 

The Trustees’ approved and signed requisitions, purchase orders, payroll checks and warrants.

 

Fiscal Officer Bailey commented that Nanci Shanley has three checks, because her time sheets (last three time sheets) were not turned in until June 1, 2009.  When the time sheets were received on Monday June 1, 2009, the payroll and tax checks were already completed for the month of May.  Due to the late submission the tax checks which had already been complete for the month of May had to be voided and re-calculated including Federal, Ohio, School Tax and OPERS. Ms.Bailey requested that the time sheets be turned in at the time they are due, not after the fact.  Trustee Butler stated he agreed.  Trustee Butler said he would notify her and if they are not turned in on time she forfeits the pay. Ms. Bailey stated that they could not do that, Mr. Butler asked how are we going to do it.  Ms. Bowers said we should encourage cooperation, She didn’t know, I’m sure she didn’t know.  Mr. Butler said he didn’t know either,

the amount of hours was so small 2 or 3 hours.  Ms. Bailey advised that 9 hours was the smallest one, Mr. Butler said he saw one for 3 or 4 hours, Ms. Bailey responded, no, 9 hours was the smallest.  Mr. Kehoe stated that he thought you were setting a limit on that pay out for the Fire Dept. Ms. Bailey stated that the limit was for the Fire Dept. Ms. Shanley had 18 hours on one, 21 1/2 hours on another and 9 hours on the last one.  Ms. Bowers felt that there would be no problem getting her to do it, she didn’t know that’s all.  Mr. Butler agreed.

 

Trustee Bowers moved to adjourn, Trustee Kehoe seconded the motion, Trustee Butler adjourned the meeting at 5:33 p.m.
